Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Swinglet mobile application (“App”) and any related services provided by Swinglet Digital Private Limited (“Swinglet”, “we”, “our”). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years of age and legally competent under Indian law to use the App. By using the App, you represent and warrant that you meet these requirements and that you are not prohibited by any applicable law or order from using such services.

2. Nature of Service

Swinglet is a social networking platform designed for adults exploring consensual relationship structures such as swinging, ethical non-monogamy (ENM) and polyamory. The App is not an escort service, dating service, or platform for the sale or purchase of sexual services.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorised use or security breach.

4. Community Guidelines & Acceptable Use

You agree to use the App in a lawful, respectful and consensual manner. You must not:

• post or share content that is defamatory, obscene, hateful, harassing, or otherwise unlawful under Indian law;
• promote or engage in non-consensual, exploitative, or abusive behaviour;
• use the App to solicit, arrange, or facilitate prostitution, trafficking, or any commercial sex work;
• impersonate any person or misrepresent your identity, age, or relationship status;
• upload content that violates intellectual property rights or privacy rights of others;
• attempt to bypass, disable, or interfere with security or safety features of the App.

We may remove content or suspend/terminate accounts that violate these Terms, our policies, or applicable laws.

5. Content Ownership & Licence

You retain ownership of content you submit or post in the App. By posting, you grant Swinglet a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute such content within the App for the purpose of operating and improving the service.

6. Privacy

Our collection and use of personal data is described in the Privacy Policy. By using the App, you consent to such collection and use. The App includes features such as screenshot protection to enhance privacy, but no technical measure is foolproof and you share content at your own risk.

7. Safety & Offline Interactions

You are solely responsible for your interactions with other users, whether online or offline. Swinglet does not conduct criminal background checks and does not guarantee the conduct or identity of any user. Use caution and common sense when arranging meetings or sharing personal information.

8. Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Swinglet disclaims all warranties, including fitness for a particular purpose and non-infringement.

9. Limitation of Liability

To the extent permitted by law, Swinglet shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the App.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us or others, or where required by law or regulation. You may stop using the App at any time by deleting your account.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana, India.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the “Effective Date” above. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
