These Terms of Use (“Terms”) govern your access to and use of the Swinglet mobile application (“App”) and related services operated by Kernel Platforms (“Swinglet”, “we”, “our”, “us”).
By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
The App is currently intended for users in India.
1. Eligibility
You must be at least 18 years old to use Swinglet.
You confirm you are 18+ and legally capable of entering into these Terms under applicable law.
We do not permit minors on the App. If an account is found to be underage, it will be removed.
2. The Service
Swinglet is a consent-first community platform for adults exploring ethical non-monogamy (ENM), polyamory, and open relationships. The App enables profile creation, posting, discovery of nearby users, messaging, and community interaction.
No escorting or transactional services. Swinglet does not facilitate prostitution, escort services, trafficking, or any transactional sexual services.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate information and to keep it updated.
You may not create accounts for others without permission or impersonate any person or entity.
Notify us immediately if you suspect unauthorized access to your account.
You agree to use Swinglet respectfully and lawfully. You must not:
Post or share illegal content or content that violates applicable law.
Share non-consensual, exploitative, or intimate content of another person.
Post nudity or explicit sexual content, including pornographic content.
Engage in harassment, threats, hate speech, or targeted abuse.
Solicit or facilitate escorting, prostitution, or trafficking.
Share content involving minors or attempt to engage minors.
Spam, scam, phish, or otherwise attempt fraud.
Share someone else’s private information without consent.
Swinglet provides reporting and blocking tools. We may take action on reports including removing content, limiting features, suspending, or permanently banning accounts.
5. User Content
“User Content” includes information, text, images, posts, and messages you submit through the App.
You retain ownership of your User Content.
You grant Swinglet a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content only as needed to operate, provide, and improve the App.
You represent that you have the rights and permissions necessary to share your User Content.
Screenshot protection may not work in all environments. Do not share anything you would not be comfortable being re-shared.
6. Moderation, Enforcement & Removal
Swinglet actively reviews reported content and may remove content or restrict accounts that violate these Terms or community guidelines.
We may remove or restrict content at our discretion to protect user safety and comply with law.
Repeated violations may result in permanent removal.
We may cooperate with law enforcement where required.
7. Subscriptions & Billing
Some features may require a paid subscription. Subscriptions are processed by Apple App Store or Google Play Store.
The app offers the following auto-renewable subscription plans:
1 Month Plan – ₹100 per month (auto-renews every 1 month)
3 Months Plan – ₹250 every 3 months (auto-renews every 3 months)
6 Months Plan – ₹500 every 6 months (auto-renews every 6 months)
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
Your account will be charged for renewal within 24 hours before the end of the current subscription period. The renewal cost will be the same as the original subscription price unless otherwise disclosed at the time of purchase.
You can manage or cancel your subscription at any time by going to your Apple ID account settings or the relevant subscription settings in your Google Play account. You may also access subscription management through the App where available, which redirects you to the relevant store account settings.
Refunds, if any, are handled by Apple or Google in accordance with their applicable payment and refund policies. We do not provide refunds directly for purchases processed through Apple App Store or Google Play Store.
We do not store your card or payment information.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect and use data.
9. Disclaimers
The App is provided on an “as is” and “as available” basis.
We do not conduct background checks and are not responsible for user conduct or offline interactions.
You are solely responsible for your interactions with other users and for maintaining your personal safety.
10. Limitation of Liability
To the maximum extent permitted by law, Swinglet and Kernel Platforms will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App.
11. Termination
You may stop using the App at any time. We may suspend or terminate your access if we believe you have violated these Terms, pose a safety risk, or where required by law.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version and update the “Last Updated” date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Courts located in Gurgaon, Haryana, India shall have exclusive jurisdiction, subject to applicable law.
